- Sponsor: The Sponsor is a joint venture of Allied Advertising Limited Partnership d/b/a Allied Advertising, 545 Boylston Street, Boston, MA 02116 and Terry Hines & Associates, 2550 Hollywood Way, Suite 600, Burbank, CA 91505.
- Eligibility: Sweepstakes open to individuals eighteen (18) years of age or older as of Jan 1, 2009. Sweepstakes void wherever prohibited by law. Employees of the Sponsor, its respective affiliates, subsidiaries and its advertising, production and promotion agencies are not eligible to participate in this contest.
- How to Enter: You may enter the Sweepstakes by visiting www.gofobo.com and following the on-screen instructions. Entries must be received by 11:59 PM (ET) on December 31, 2009, in order to be valid. Limit one (1) entry per e-mail address.
- Prizes: One prize will be awarded at the end of the contest period. No substitutions for prizes except by Sponsor or as may be necessary due to unavailability, in which case prizes of equal or greater value will be awarded. Prizes are not transferable or redeemable for cash. All taxes and other expenses not specified herein are the sole responsibility of the winner. Sponsor responsibility is only for prize delivery. Sponsor is not responsible for prize utility, quality, purpose or associated activation charges and/or monthly fees and charges associated with usage. Acceptance of the prize constitutes permission to use winner’s name, hometown and likeness for purposes of advertising, promotion and publicity without additional compensation.
- Drawings: Prize winner will be selected in a random drawing from among all eligible entries received during the contest period. Drawings will be conducted by an independent judging organization whose decisions are final in all respects. Prizes are guaranteed to be awarded, assuming sufficient number of entries are received. Winners will be notified by mail, telephone or e-mail on or about seven days after the drawing. If any prize notification letter or any prizes are returned as undeliverable, the prize will be awarded to an alternate winner selected in a random drawing.
- Odds: Odds of winning a prize depend upon the number of entries received.
- General Conditions: Sponsor reserves the right to cancel, suspend or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factors beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, or to be acting in violation of these Official Rules or those of any other promotions, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. This Sweepstakes offer is void where prohibited or restricted by law and is subject to applicable federal, state, local and municipal laws and regulations. Sponsor is not responsible for late, lost, stolen, damaged, incorrect, incomplete, illegible, cobbled, misaddressed, or misdirected entries, or for errors, omissions, interruptions, deletions, defects or delay in operating or transmission of information regarding the Sweepstakes. All federal, state and local taxes associated with the awarding and receipt of any prizes are the sole responsibility of the winners.
- Limitation of Liability: Sponsor disclaims any liability for damage resulting from the participation in, or accessing or downloading information in connection with this Sweepstakes and reserves the right at its sole discretion to modify, cancel, terminate and suspend this Sweepstakes should any virus, bug, technical failure, unauthorized human intervention or other causes beyond Sponsor’s control corrupt or affect the administration, security, fairness or proper conduct of this Sweepstakes. The Sponsor is not responsible for any incorrect or inaccurate information whether caused by entrance, printing errors or by any of the equipment or programming associated with or utilized in this Sweepstakes, or the technical failures of any kind, including, but not limited to malfunctions, interruptions or disconnections in hardware or software or late, lost or undeliverable, damaged or stolen mail, or any injury or damage to person or property which may be caused, directly or indirectly, in whole or in part from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. No more than the stated number of prizes will be awarded. In the event of any cancellation, termination or suspension, a notice will be posted and a random drawing will be held from among all eligible entries received prior to such time. By participating in this Sweepstakes each and every entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decision of the judges and warrants that he or she is eligible to participate in these Sweepstakes. By accepting a prize, winner agrees to release the Sponsor, its respective directors, employees, officers and agents, including without limitation their advertising and promotion agencies from any and all liability, loss or damages arising from or in connection with the awarding, receipt and/or use or misuse of any prize or participation in any prize-related activities.
- Winners Name: For a copy of the winners name, send an e-mail with subject line “Gofobo Sweepstakes winners list request" to info@gofobo.com. Request must be received by January 30, 2010.
- Notice to Entrants: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
- Disputes: Except where prohibited, entrant agrees that (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the Massachusetts State Court, located in Suffolk County, Boston, Massachusetts USA; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorney’s fees; (iii) under no circumstances will entrants be permitted to obtain awards for, and entrant hereby waives all rights to, claims, indirect, punitive, incidental or consequential damages, or any other damages other than for out-of-pocket expenses and any and all rights to have damages multiplied or otherwise increased; and (iv) any and all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the entrant and Sponsor in connection with this Sweepstakes shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.
